Terms & Conditions

1. Acceptance of these Terms

By downloading, installing, or using any NexGen Innovations app, website, or service (“Service”), you agree to this legally-binding contract with NexGen Innovations (“NexGen,” “we,” “us”). If you do not accept **all** terms, do not use the Service.

2. Eligibility & Accounts

  • You must be at least 13 years old (or the legal age in your country) to create an account or make purchases.
  • You’re responsible for all activity that occurs under your account and for keeping credentials confidential.

3. Limited Licence

NexGen grants you a personal, non-exclusive, non-transferable, revocable licence to use the Service on devices you own or control, strictly in accordance with these Terms, our Privacy Policy, and any app-store rules.

4. In-App Purchases & Subscriptions

  • Prices are displayed in-app and may change for future purchases or renewals; we’ll notify you of increases as required by law.
  • Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period via the relevant app-store settings.
  • Billing and refunds for store purchases are handled by Google Play / Apple App Store; see our Refund Policy for details.

5. User-Generated Content

If a Service lets you upload, post, or share content (“UGC”):

  • You retain ownership of your UGC but grant NexGen a worldwide, royalty-free licence to store, display, and improve the Service with it.
  • You must have all rights to the UGC and it must not infringe third-party IP, be unlawful, or contain malware.

6. Prohibited Conduct

  • Reverse-engineering, decompiling, or attempting to extract source code.
  • Distributing viruses, spam, or other harmful code.
  • Using bots or automated scripts to scrape, harvest, or overload our servers.
  • Engaging in hate speech, harassment, or illegal activity through the Service.

7. Updates & Availability

We may push automatic app updates, add or remove features, or discontinue the Service at any time. We are not liable for any loss resulting from modification or downtime.

8. Intellectual Property

All NexGen trademarks, logos, code, and content are protected by copyright and other IP laws. Nothing in these Terms transfers ownership to you.

9. Third-Party Services

The Service may integrate SDKs (e.g. analytics, ads) or link to sites we don’t control. We’re not responsible for third-party content or privacy practices—see their policies.

10. Disclaimer of Warranties

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied.

11. Limitation of Liability

To the maximum extent permitted by law, NexGen shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of data, revenue, or profits arising out of your use of the Service.

12. Indemnification

You agree to indemnify and hold harmless NexGen from any claims, damages, or expenses arising from your breach of these Terms or misuse of the Service.

13. Termination

We may suspend or terminate your access at any time with or without notice if we believe you have violated these Terms or pose a risk to other users. On termination the licence in §3 ends, but §8–§13 survive.

14. Governing Law & Venue

These Terms are governed by the laws of India without regard to conflict-of-law provisions. You agree to submit to the exclusive jurisdiction of the courts of Goa for any dispute that cannot be settled informally.

15. Changes to These Terms

We may update these Terms to reflect new features or legal requirements. We’ll notify you in-app or via our website. Continued use after the “Effective” date means you accept the new Terms.
